The US Consumer Product Safety Commission regulates products which cause unreasonable risks of serious injury or death for more than 15,000 types of products including toys, house hold items, sports and recreation, outdoor and specialty. There are currently more than 4,000 product recalls the public should be aware of, with more added each month.
Although the Model Uniform Products Liability Act is a guideline for how states handle product liability statues, and no Federal product liability law exists, manufactures are responsible for producing and selling products which are safe for public use under the Uniform Commercial Code.
A manufacturer can be held liable if a product is proven defective in design, manufacturing or marketing. A design defect exists before the item is produced and was flawed in concept or development. Manufacturing defects occur while the product is being made. Marketing defects exist when instructions do not adequately warn consumers of dangers or when instructions are improperly written.
